Diego Sanchez is going to jail. Judge Stan Whitaker sentenced the original Ultimate Fighter winner on Wednesday to 30 days at the Bernalillo County Metropolitan Detention Center, plus a mandatory drug and alcohol rehab program, after a September arrest broke the terms of his probation. KOB 4 first reported the sentence.
The arrest happened September 7 in Socorro, New Mexico, at 5:17 p.m. local time. Police booked Sanchez on two counts: aggravated driving under the influence and probation violation.
That probation was supposed to run five years. A court handed it down in March 2026 over the July 2025 incident in which Sanchez, riding as a passenger on a New Mexico highway, climbed out the car window and fired a gun into the air.
Whitaker made it clear he weighed something heavier. “If you’re not going to take advantage of those opportunities, maybe DoC is the call,” he said, floating the option of letting Sanchez do his time and parole instead of stacking up multiple cases. Then he pulled back: “but I don’t think it’s warranted yet, Mr. Sanchez.” He landed on a sanction and reinstated the probation, pointing to the fact that this was Sanchez’s first violation. “I think a sanction is in store with reinstatement, which is what I’m going to do because it’s a first offense.”
Then came the warning. Whitaker said the state would push hard for custody if Sanchez picks up anything new. “I don’t want that, but if you can’t take advantage of the programs, I will have no other choice.”
There’s a medical wrinkle, too. Sanchez is scheduled for hip surgery, and according to the report he can’t have it until he finishes the sentence.
The gun case itself got strange in court. At the March hearing, the 44-year-old said nobody was hurt, called the shooting a joke and disclosed that he takes medication for a bipolar diagnosis. “People do make mistakes, you know,” Sanchez said. “This is Albuquerque, the wild wild west; I made a bad mistake.” State prosecutor Genia Gonzales didn’t find it funny. “The defendant has shown reckless actions when he shot the firearm out of the car window,” she said.
The fighting résumé is why any of this makes headlines. Sanchez won the middleweight tournament on the very first season of TUF, finishing Kenny Florian by first-round TKO in 2005. He dropped to welterweight right after, then eventually to 155, where he beat Clay Guida by split decision in the TUF 9 finale main event. That fight was so wild the UFC put it in the Hall of Fame’s Fight Wing in 2019. It also earned him a lightweight title shot against BJ Penn at UFC 107, which ended with a doctor stoppage in the fifth round. His UFC run closed in 2020 with a loss to Jake Matthews at UFC 253.
This was a soft landing by any standard. Thirty days, rehab and the same probation he already had is about as gentle as a judge gets with a guy who violated a gun-case deal with a DUI, and Whitaker basically said so out loud. Sanchez spent a career walking forward into punches and asking for more. The next 30 days are a fight he gets to win by sitting still, and then there’s a hip to fix.
